Polish draft clarifies 30-day pay-information replies and first-report rules

16 October 2026 Partly in force Partly in force

Poland’s UC127 draft specifies a 30-day information deadline, a rolling remuneration period and nominal-hour calculations. It fixes first-report dates but leaves a timing conflict with commencement that employers must resolve against the final law.

What changed

The operative draft dated 29 April 2026 resolves previously unverified technical fields. Employee information uses the twelve months of paid remuneration preceding the request month, with a maximum 30-day reply. Hourly levels use nominal contractual hours and the pay-level definition excludes specified uniform benefits and termination benefits. Article 72 fixes first reports at 7 June 2027 for 150+ and 7 June 2031 for 100–149, while the first 150+ period depends on commencement and Article 74 delays commencement six months after publication. Joint assessment follows fixed September, October and November milestones, rather than a uniform six-month trigger.

What it means for employers

Continue the enacted recruitment rules. Prepare the draft data and response workflows, including progression-information requests below 50 employees, but verify final commencement and first reporting periods before scheduling the broader UC127 duties.
