Netherlands amendment would allow fines for unequal pay itself
A new Tweede Kamer amendment to bill 36 949 would add the core equal-pay obligation itself to the bill's administrative-enforcement regime. The amendment is proposed and has not yet been adopted.
What changed
Amendment 36949-8 inserts Article 7(1), the bill's equal-pay obligation, into three administrative-enforcement provisions. Its explanatory memorandum says the bill currently permits administrative fines for duties such as reporting but not for the existence of unequal pay itself; the amendment would make unequal-pay violations administratively fineable alongside existing civil remedies.
What it means for employers
Dutch employers should treat enforcement exposure as potentially broader if the amendment is adopted. It does not make the bill operational or change the proposed commencement or reporting timetable; it remains a parliamentary proposal.
