Upper Austria enacts regional public-service pay-transparency rules

Upper Austria has enacted a Directive 2023/970 implementation for its Land and municipal public service. The pay-transparency provisions apply retroactively from 7 June 2026 and include worker-information, reporting and joint pay-assessment duties.

What changed

The tracker previously captured Austria's federal procurement implementation and Lower Austria/Styria regional measures but had missed Oö. LGBl. No. 57/2026. The Upper Austria law was adopted on 9 July and promulgated on 30 July 2026, with its Directive-specific pay-transparency provisions retroactively effective from 7 June. It introduces regional salary-history restrictions, accessible objective pay criteria, a two-month worker-information route with annual notice, reporting from 100 employees, and a joint pay assessment where a category gap is at least 5%, unjustified and unremedied for six months. Upper Austria's 250+ and 150–249 reports are first due 7 June 2027; 100–149 reports are first due 7 June 2031.

What it means for employers

Covered Upper Austria public-service employers should treat these regional duties as already live from the retroactive 7 June 2026 start and align recruitment, pay-information, reporting-data and 5%/six-month JPA controls accordingly. The measure does not enact Austria's nationwide private-sector core Directive package, so private-sector employers should not generalise the Upper Austria rules nationally.
